Acceptance of Terms

These Terms govern your access to and use of Izegi, the app discovery platform available at izegi.com and through associated services (the “Platform”). By visiting or using the Platform, you agree to be bound by these Terms and all applicable laws and regulations. If you do not agree with any part of the Terms, please do not use the Platform. If you are using the Platform on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

Modifications to Terms

Izegi may revise these Terms from time to time. When we revise terms, we will provide notice through the Platform or other reasonable means. Your continued use of the Platform after the effective date of the revised Terms constitutes your binding acceptance of the updated Terms. If you do not agree to the changes, you may terminate your use of the Platform.

Intellectual Property

All content and materials on the Platform, including software, interfaces, graphics, logos, and textual content, are owned by Izegi or licensed to Izegi. Nothing in these Terms grants you any right, title, or interest in the Platform’s proprietary content except for the limited rights expressly described herein. You may access and view content for your personal, non-commercial use in connection with valid use of the Platform, but you may not reproduce, modify, distribute, display, perform, or create derivative works without Izegi’s prior written consent. Trademarks and service marks displayed on the Platform are the property of Izegi or their respective owners. Unauthorized use of Izegi’s marks is strictly prohibited.

You may submit content or feedback through the Platform in accordance with applicable rules. By submitting content, you grant Izegi a non-exclusive, royalty-free, worldwide license to use, reproduce, display, and distribute such content solely in connection with the operation and improvement of the Platform.

Third-Party Links and App Hosting

The Platform serves as a gateway for discovering applications that are hosted and distributed by third-party stores, principally the Google Play Store. The actual hosting, distribution, billing, security, privacy practices, and terms governing those apps are determined by Google Play and by the individual app developers. Izegi does not host the apps on our servers and does not control the store infrastructure.

Any listing on the Platform that links to an app is a hyperlink to an external store. Izegi does not sponsor, guarantee, or warrant the safety, quality, or functionality of third-party apps. Your use of those apps is governed by the terms and policies of the Store and the app developers. Izegi shall not be liable for any claims, damages, or losses arising from third-party apps or their use.

Disclaimer of Warranties

THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IZEGI DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFINGEMENT, TITLE, OR ACCURACY. IZEGI DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE FROM SECURITY VULNERABILITIES. CONTENT AND APP LISTINGS MAY BE OUT OF DATE, INCOMPLETE, OR INACCURATE. USE OF THE PLATFORM IS AT YOUR OWN RISK.

IZEGI DOES NOT WARRANT OR ASSUME RESPONSIBILITY FOR THE CONTENT, QUALITY, OR SAFETY OF THIRD-PARTY APPS, OR FOR THE PRACTICES OF APP DEVELOPERS. LINKS TO THIRD-PARTY SITES OR STORES ARE PROVIDED FOR CONVENIENCE ONLY. YOUR RELIANCE ON THIRD-PARTY CONTENT IS AT YOUR OWN RISK.

Limitation of Liability

TO THE EXTENT PERMITTED BY APPLICABLE LAW, IZEGI, ITS AFFILIATES, OFFICERS, EMPLOYEES, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM OR INABILITY TO USE THE PLATFORM, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL IZEGI’S TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS EXCEED THE GREATER OF ONE HUNDRED FIFTY DOLLARS (US$150) OR THE AMOUNT PAID BY YOU TO IZEGI, IF ANY, IN THE TWELVE MONTHS PRECEDING THE CLAIM.

Indemnification

You agree to defend, indemnify, and hold Izegi and its affiliates, officers, directors, employees, and agents harmless from and against any claims, losses, damages, liabilities, costs, or expenses (including reasonable attorneys’ fees) arising from your use of the Platform, your violation of these Terms, or your infringement of any third party rights.

Governing Law and Dispute Resolution

These Terms are governed by the laws of the jurisdiction in which Izegi is incorporated, without regard to conflicts of laws principles. You agree to resolve disputes through good-faith negotiations. If a dispute cannot be resolved amicably, you agree to binding arbitration or the venue permitted by applicable law, subject to any rights you may have to pursue a claim in a court of competent jurisdiction where required by law.

Termination

Izegi may suspend or terminate your access to the Platform at any time for violations of these Terms or for other reasons, with or without notice. Upon termination, all licenses and rights granted to you under these Terms terminate, and you must discontinue your use of the Platform. Provisions relating to ownership, liability, and indemnification shall survive termination as applicable.

General Provisions

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect. No waiver of any term shall be deemed a further or continuing waiver of such term. You may not assign or transfer your rights under these Terms without Izegi’s prior written consent. These Terms constitute the entire agreement between you and Izegi regarding the Platform and supersede all prior agreements. Data Privacy

Your use of the Platform is also governed by Izegi’s Privacy Policy, which describes how we collect, use, and share information about you. By using the Platform, you consent to the practices described therein.
